Grandmother Olga Motornyuk plays a special role here. Deceived, she willingly handed over her granddaughter to a complete stranger. And then she went to the RG editorial office for help. “Trusting and stupid, I allowed a stranger to take my granddaughter Juliana,” she regretted and asked for help to return the baby to her. Thus she began a journalistic investigation and the fight for Juliana’s return to her family. But the path to a happy ending, as we have already told (“Mom’s Misfortune”, “RG” – Week-Kuban-North Caucasus of September 20, 2023), turned out to be long and difficult.

However, the situation itself is not simple. The girl’s mother is a member of a large Russian family that moved to Russia from Uzbekistan. At first, Olga and her two daughters settled in the Tver region. And then, to the Kuban, where her relatives moved after them. “It is hot here, like in Uzbekistan, and there is also a lot of fruit.” Her daughter Kristina got married and a girl, Yuliana, was born. But when the girl was one and a half years old, there was a conflict between her parents, after which her father went to work in another region and her mother entered a medical institution with severe depression.

Left with her granddaughter in her arms, the grandmother panicked: what to do? I went to the guardianship authorities for advice. But instead of advice… they offered to send the girl to an orphanage. But she, they say, cannot be a guardian. Since the grandmother is single, unmarried and she does not have a steady job. Although Olga is a good manicurist, she never stops receiving clients. But the individual entrepreneur at that time was not yet registered. And then they found someone else’s aunt, who had income and a legal spouse. Only there were no children.

“The woman began to convince herself that she was driven by the desire to help find a way out of the current situation,” the grandmother recalls. -And the Department of Family and Children’s Affairs assured that she would be granted temporary guardianship until I gathered all the necessary documents. So I decided to choose the lesser of two evils: it is better to give my granddaughter to a “good woman” than to send her to an orphanage.

The grandmother went to the guardianship authorities for advice. But instead of advice… they offered to send the girl to an orphanage. And she, they say, cannot be a guardian.

However, the lesser evil grew rapidly. After the grandmother, with the participation of a city official (?!), signed a voluntary waiver of guardianship in the new guardian’s house (although she had no right to do so if she had living parents and had no legal basis) . TP), the mother was decided by the Sovetsky District Court. The girls had limited rights and the father was completely deprived of them. Then the new “mother” almost completely stopped the girl’s communication with her blood relatives.

When my own mother was released from the hospital and my father, upon returning from work, returned to the family, they were both shocked by what had happened. But they would not tolerate it and a lawsuit was filed. Blood relatives had to make enormous efforts to have the decisions of the Sovetsky District Court of Krasnodar overturned. And only in May 2022, the Fourth Court of Cassation of the General Jurisdiction, pointing out serious violations committed by inferior colleagues, sent the civil case to a new trial. The designated examination then confirmed that the mother’s health status allows her to raise her own daughter. In addition, the girl has many other relatives, including a young grandmother…

During the re-examination of the case, which took place with the participation of the Ombudsman for Children’s Rights, the regional court took all this into account. And although employees of the Department of Family and Children’s Affairs of the Krasnodar administration tried to convince the court that they acted legally by handing over the child to a complete stranger, their arguments were refuted by examinations and other irrefutable evidence.

However, the matter did not end there. The Krasnodar guardianship authorities, with amazing tenacity, continued to seek the return of the child to his adoptive mother. And she stubbornly clung to this name. Apparently, she really liked receiving rewards from the guardianship authorities for her “mother’s work.” At least, as it turned out later, she “attached” frightening diagnoses to the child in private clinics in order to increase these payments. What feelings and maternal love can we talk about here? Is it about the passion for money? It is no coincidence that now this “loving aunt” is trying to “take” 700 thousand rubles from her mother in the form of unpaid alimony. That is, she spent money on the child and needs to be compensated for her expenses… It is good that, fortunately, the girl has not reached the point of “receiving” disabled status: her diagnoses, after returning to her family, They were not confirmed.

The other day, the Fourth Court of Cassation of General Jurisdiction put an end to this clearly protracted litigation. He left the baby with his mother and his grandmother. Juliana is already five years old. And, as RG correspondents were convinced, the baby is happy in her own family.

– After carefully studying all the documents that were given to me, I came to the conclusion that in this story there are no exceptional circumstances that would allow a child to be separated from his mother. Information about the mother’s inability to raise her daughter for medical reasons did not correspond to the conclusions of two forensic medical examinations. Furthermore, our personal communication with the family and the child convinced us of the mutual bond between the child and his close relatives. And the court finally supported our position, based on the fact that a child who has blood relatives should be raised in a loving family. This is precisely what the state family policy aims at: restriction, and especially deprivation of parental rights, are extreme and exceptional measures. In the story with Yuliana this was ignored, as shown by the journalistic investigation carried out by the Rossiyskaya Gazeta correspondent.
