Senator Flávio Bolsonaro (PL-RJ) filed a request for the AGU (Attorney General of the Union) to open an investigation against the president of the PT and federal deputy, Gleisi Hoffmann (PR), for having questioned and asked for an end to the Electoral justice.
She called the fact that Brazil has a specific branch of the Judiciary for this issue “absurd”, but retreated a day later, in the face of a strong reaction from Minister Alexandre de Moraes, president of the TSE (Superior Electoral Court).
On Wednesday (20), Gleisi had criticized the TSE’s performance in the Amnesty PEC voting session by stating that the court has applied unenforceable fines to parties, threatening democracy.
According to her, the decisions of the electoral courts “bring the subjective vision of the court’s technical team, which systematically enters the lives of political parties, wanting to provide guidance, interpreting the will of leaders, the will of candidates.”
The PT member also said that the courts have applied unenforceable fines to parties – “there is no way to pay, we don’t have money” – and that the existence of a court focused on electoral issues is an exception in the world, a situation that she classified as “absurd “.
“There cannot be an Electoral Court, which, in fact, is one of the only ones in the world. One of the only places that has an Electoral Court in the world is in Brazil. Which is already absurd.
The PT member also questioned the expenditure on maintaining the Electoral Court, stating that it costs three times the amount allocated to campaigns. “There’s something wrong with this,” she added.
The PT president’s speech provoked reactions from the Electoral Court.
President of the TSE, Moraes released a note in which he classified Gleisi’s speech, without quoting her directly, as “erroneous and false” and said that the Electoral Court will continue to “combat those who are contrary to constitutional ideals” and the “forces who do not believe in the democratic rule of law”.
Also in a note, Abradep (Brazilian Academy of Electoral and Political Law) reacted to Gleisi and said the “creation of the Electoral Justice met and meets the demands specific to Brazilian democracy.”
“Institutional improvement is important and must be the subject of broad debate in Parliament and society. This debate, however, must resist the easy appeal of presenting global costs for maintaining Electoral Justice.”
Gleisi then retreated this Friday (22) and stated that he did not call for the end of the Electoral Court in a speech.
“I didn’t ask for the end of the Electoral Justice, I was misunderstood, my speech was taken out of context and misunderstood within the debate on a proposal that gives amnesty to political parties, fines, accountability and the electoral process”, stated Gleisi.
