The Attorney General’s Office (PGR) presented this Friday (22) to the Federal Supreme Court (STF) the first ten agreements of non-criminal prosecution of those investigated for the coup acts of January 8. The group is accused of inciting the acts.
To sign the agreement with the prosecutor’s office, the accused confessed to the crimes and committed to paying fines ranging from R$5,000 to R$20,000, in addition to providing services to the community, prohibiting the use of social networks and participating in a course on democracy. In exchange, the process that could lead the accused to conviction is suspended.
To be valid, the agreements must be approved by the rapporteur of the processes, Minister Alexandre de Moraes.
According to the PGR, of the 1,125 people reported who are entitled to the agreement, 301 have already expressed an interest in joining the benefit.
Those investigated who participated in the acts of depredation of Congress, the Planalto Palace and the Federal Supreme Court (STF) will not be entitled to the benefit.
Under the non-criminal prosecution agreement (ANPP), those accused of crimes committed without violence or serious threat and with a minimum sentence of four years can confess to the crimes in exchange for measures other than prison, such as repairing the damage caused, handing over the goods that are the fruits crime, payment of fines and provision of services to the community.
Last week, the Supreme Court sentenced the first three accused of participating in the acts for the crimes of armed criminal association, violent abolition of the Democratic Rule of Law, attempted coup d’état, qualified damage through violence and serious threat and deterioration of listed property.
