Indigenous peoples from different regions of the country are mobilized this Wednesday (20), in Brasília, against the thesis of the time frame for their territories, which is once again being judged by the Federal Supreme Court (STF), and against the Bill ( PL) 2,903/2023 which deals with the same topic. The people also demand the immediate demarcation of their lands. PL 2,903/2023 establishes that indigenous peoples only have the right to areas that were already occupied by them on the day the 1988 Federal Constitution was promulgated (October 5 of the same year).

Approved by the Chamber of Deputies, the project received a favorable opinion from the rapporteur, senator Marcos Rogério (PL-RO), and was under analysis by the Senate’s Constitution and Justice Committee (CCJ) this morning.

The protests began in front of the National Library, in the center of the capital, with around a thousand indigenous people, organized by the Articulation of Indigenous Peoples of Brazil (Apib) and the Indigenous Missionary Council (Cimi).

The indigenous people formed separate circles of men and women to dance and sing songs of their people. On their bodies painted with liquids extracted from the Amazonian fruits genipapo and annatto, they displayed typical adornments with beads and feathers.

In their hands, tools such as clubs, bows and arrows. Elderly people, young people and indigenous children also held posters and banners demanding rights.

In a press conference, indigenous leaders took a stand against the time frame in their territories. Chief Kretã Kaingang, one of Apib’s coordinators, questioned the vote of STF minister Alexandre de Moraes in the part that deals with compensation to farmers who currently occupy the land.

“What worries us a lot is the issue of compensation for bare land, prior compensation. We are not against the payment of compensation to small farmers, but this cannot be included in the vote on the time frame. It has to be left out.”

For the indigenous leader, the occupants of the lands must go to court to collect compensation from the state and federal governments. “Don’t place any more responsibility on us, the indigenous peoples of Brazil, to avoid conflict. Because if Minister Alexandre de Moraes’ thesis remains, many conflicts will still happen.”

Then, at around 12:30 pm, the indigenous people left on a peaceful march along the Esplanada dos Ministérios to Praça dos Três Poderes, where they will follow the STF trial this afternoon.
