The Minister of Justice, Flávio Dino, announced that the Federal Police (PF) will analyze whether the investigators of Operation Lava Jato committed “possible crimes” in the management of funds. According to the minister, a working group will be created to investigate movements of financial resources by the 13th Federal Court of Curitiba, as shown in a partial report by the Internal Affairs of the National Council of Justice (CNJ).

Dino said that he received a report from the national inspector of justice, minister Luís Felipe Salomão, which points out that the CNJ, based on an administrative investigation, found irregularities in the approval and management of collaboration and leniency agreements signed by the 13th Federal Court of Curitiba. At the time of Lava Jato, the Court had the now senator Sergio Moro (União-PR) as its main judge.

“I received a letter from the national inspector of justice, minister Luís Felipe Salomão, forwarding a report on the administrative investigation carried out into financial transaction procedures in the 13th Federal Court of Paraná, during ‘Operation Lava Jato'”, said Dino on X, formerly Twitter.

According to the CNJ, the audit attested to a “chaotic management” in controlling fines negotiated with whistleblowers and companies. The council also states that magistrates and members of the task force had acted in “collusion” to allocate the fines from the plea bargains and leniency agreements to Petrobras’ coffers, because they knew that the money would be used by the state-owned company to pay the fine abroad and that part of these resources would go back to a project called “Fundação Lava Jato”.

“The existence of possible collusion involving the various operators of the justice system was verified, in order to allocate values ​​and resources in Brazil, to allow Petrobras to pay for agreements abroad that would return to the exclusive interest of the task force”, he says an excerpt from the inspection report.

The Minister of Justice stated that the creation of a working group to “deepen analyzes and adopt preventive measures” was recommended by Salomão. The magistrate also suggested the adoption of international legal cooperation.

Moro says the report would be a ‘mere preliminary opinion’

On the 15th, Moro stated that the possible irregularities cited in the CNJ report are a “mere preliminary opinion without basis in facts”. According to the senator, the leniency agreements were previously approved, before ratification, by the 5th Review Chamber of the Federal Public Ministry, which works alongside the Attorney General of the Republic.

“With regard to the allegations about the creation of a foundation (Fundação Lava Jato) to manage values ​​of agreement between Petrobras and the DOJ/SEC of the United States, which did not materialize, this is in fact after my departure from 13th Federal Court”, said the senator.
