The Minister of Justice, Flávio Dino, sent the report of the national inspector of Justice, Minister Luís Felipe Salomão, on the financial transactions of Operation Lava Jato to the Federal Police to investigate any irregularities.

The announcement by the holder of the portfolio was made on his social networks this Monday (18) and occurred amid an offensive by the Executive, the PGR (Attorney General’s Office) and the STF (Supreme Federal Court) against the operation initially launched in Paraná.

“The inspector suggests the creation of a working group to deepen analyzes and adopt preventive measures, including international legal cooperation. In addition to agreeing with this proposal, I will send the report from the National Inspectorate for analysis by the Federal Police, regarding possible crimes perpetrated about the allocation of financial resources handled by ‘Lava Jato'”, said Dino.

Last Friday (15), the CNJ (National Council of Justice) Internal Affairs stated that it found “chaotic management” and “possible collusion” in the control of amounts arising from plea bargain and leniency agreements signed with the Lava task force Jet in Curitiba and approved by the court under the responsibility of the then judge Sergio Moro.

The current senator for União Brasil-PR denied, on Friday, that there had been any irregularity during his period as head of the Federal Court of Paraná.

The inspector’s statements are in the report that was sent to the department.

During a press conference at the ministry, Dino said that Salomão considers it to be a “public and well-known fact” that “there was a lack of management control and, therefore, he asks for a reflection on the procedures relating to deposits (made to Lava Jato)”.

“If I receive a document from the CNJ today with a narrative of crimes, it’s not that I can, I am obliged to send it to the judicial police so that they can carry out the investigation. These are the two measures that I must take tomorrow. On the one hand, fulfilling the obligation to send it to the PF, and on the other hand, the analysis and search for the creation of this working group to investigate the origin and destination of this money”, he stated.

The PT government has approached Lava Jato as a setup to oust the party from power over the past decade. On the one hand, the speech focuses on abuses committed by the operation but, on the other, it minimizes confessed crimes and recovered billions of dollars.

The offensive against the operation commanded by the then judge Moro had a final chapter on the 6th, when Minister Dias Toffoli, of the Supreme Court, decided to declare the evidence of the construction company Odebrecht against politicians useless and to order the criminal investigation of prosecutors who signed the agreement leniency with the contractor.

Toffoli’s measure even invalidated spreadsheets of supposed payments and should affect dozens of actions still pending in Lava Jato developments across the country.

Moro left the judiciary in 2018 to join the Bolsonaro government as Minister of Justice, a position he left in 2020, making accusations of interference in the then-president’s PF. The former judge then ended up joining the Senate for Paraná, a position for which he was elected, made peace and supported Jair Bolsonaro (PL) in the second round.

The former coordinator of the task force, Deltan Dallagnol, left the Public Ministry to run for the Chamber of Deputies last year and declared support for Bolsonaro in the second round. This year, however, Deltan was revoked following a decision by the TSE (Superior Electoral Court).

He was accused of having left his career as a prosecutor to enter politics because he responded to investigations, disciplinary complaints and requests for action from the CNMP (National Council of the Public Ministry) – which oversees the functional duties of members of the Public Ministry.

In addition to Toffoli’s decision, several measures were taken regarding the investigations. Most of them refer to facts that have been public knowledge for a long time, but which only now, during the Lula government, have aroused interest in being punished by authorities.

The assessment of members of higher courts is that the climate against Lava Jato makes it easier to repair abuses committed by it. They also point out that the decisions against the operation serve to make gestures to Lula, responsible for appointing vacant positions in the most important courts in the country – Dino is one of those tipped to fill Rosa Weber’s vacancy on the STF.

Now, the movement has gained even more strength and targets the agents who were responsible for the investigations.
