This Friday, September 22nd, from 7pm, at Livraria da Travessa, in Casa Park, the launch of the book “A Aplicação do Legítimo Interesse na LGPD” will take place. Authored by lawyer Juliana Costa – Master in Law, Justice and Development and Specialist in Privacy and Data Protection -, the work deals with the rights and normative criteria for measuring the General Personal Data Protection Law.

“In the book I seek to bring regulatory solutions to the National Data Protection Authority regarding a controversial article in the LGPD. When we talk about the General Personal Data Protection Law, we immediately think about consent from the holder of this data. However, it is not always that this consent is used, perhaps mandatory”, explains Juliana.

The expert also says that there are other ways of using the consumer/client’s personal data without their consent and, one of them, is when it is understood that the individual necessarily has an interest in a certain product or service.

“For example, an individual visits a website and shows an interest in a certain service. Later the company, or store, sends emails about that product, promotions, stock renewals, etc. Clearly this individual showed interest. However, he did not he needed to give his consent and it is not enough for the company to provide the opportunity to revoke these submissions to him. It will only be in fact complying with the legislation if it has previously drawn up a prior document confirming that the use of this legal basis is appropriate”, he highlights.

Juliana emphasizes that the document, called LIA, must be drawn up on a case-by-case basis to legitimize, according to the LGPD, that there actually existed a Legitimate Interest, and that is what this work is about: how to reduce the bureaucracy of not needing to carrying out so many documents and, instead, creating exhaustive hypotheses for using the Legitimate Interest instrument through its regulation according to the LGPD.

According to the author, the book aims to help public and private organizations by facilitating their procedures and flows when the purpose is to use the personal data of individuals based on this legal basis. “The work also makes it unnecessary to prepare this document in certain situations that are more common in day-to-day business activity. Because of this, the aim is to help public and private organizations, in addition to providing greater legal security to society, avoiding excesses and helping to ensure compliance with their procedures”, she concludes.

Illustrious presences

The launch will be attended by authorities, personalities and professionals in the areas. Among the guests were ministers Gilmar Mendes, from the Federal Supreme Court (STF); Assusete Magalhães and João Otávio de Noronha, from the Supreme Court of Justice (STJ); the deputy attorneys general of the Republic, Paulo Gustavo Gonet (PGR) and Brasiliano Pereira dos Santos (MPF Superior Council); and the judge of the DF Regional Electoral Court (TRE-DF), Francisco José de Campos Amaral.

Also expected are representatives of the Federal District Bar Association (OAB/DF), president Délio Lins e Silva; and Alice Lins e Silva, from the Federal Council. The attorney for the Central Bank of Brazil, Vinícius Batista Soares, should also participate in the evening; Rodrigo Badaró de Castro, from the National Council of the Public Ministry; the director of the National Data Protection Authority (ANPD), Arthur Sabbat; and Fabrício da Mota Alves, from the National Data Protection Council (CNPD);

About Juliana Costa

Lawyer Juliana Costa has a Master’s degree in Law, Justice and Development from the Brazilian Institute of Education, Development and Research (IDP). She is also a specialist in Personal Data Protection and Compliance, author of several articles in the area, and developer of policies and compliance with LGPD through the implementation of a customized program, in addition to having extensive experience in Data Protection in law firms and companies consultancy in LGPD and public bodies.
